GeneralProvisions
Article1Inordertoregulateexit/entryadministration,safeguardthesovereignty,securityandsocialorderofthePeople’sRepublicofChina,andpromoteforeignexchangesandopeningtotheoutsideworld,thisLawisherebyformulated.
Article2ThisLawisapplicabletotheadministrationofexitandentryofChinesecitizens,entryandexitofforeigners,stayandresidenceofforeignersinChina,andtheexit/entryborderinspectionoftransportvehicles.
Article3TheStateprotectsChinesecitizens’legitimaterightsandinterestsofexitingandenteringthecountry.
ThelegitimaterightsandinterestsofforeignersinChinashallbeprotectedbylaws.ForeignersinChinashallabidebytheChineselaws,andshallnotendangerChina’snationalsecurity,harmpublicinterestsanddisruptsocialandpublicorder.
Article4TheMinistryofPublicSecurityandtheMinistryofForeignAffairsshall,withinthescopeoftheirrespectiveresponsibilities,beresponsibleforadministeringexit/entryaffairs.
EmbassiesandconsulatesofthePeople’sRepublicofChinaandotherinstitutionsstationedabroadentrustedbytheMinistryofForeignAffairs(hereinafterreferredtoas“thevisa-issuingauthoritiesabroad”)shallberesponsibleforissuanceofentryvisastoforeigners.Exit/entryborderinspectionauthoritiesshallberesponsibleforcarryingoutexit/entryborderinspection.Publicsecurityorgansunderlocalpeople’sgovernmentsatorabovethecountylevelandtheirexit/entryadministrationsshallberesponsiblefortheadministrationofthestayandresidenceofforeigners.
TheMinistryofPublicSecurityandtheMinistryofForeignAffairsmay,withinthescopeoftheirrespectiveresponsibilities,entrustexit/entryadministrationsofpublicsecurityorgansorforeignaffairsdepartmentsunderlocalpeople’sgovernmentsatorabovethecountyleveltoacceptforeigners’applicationsforentry,stayandresidenceinChina.
Intheadministrationofexit/entryaffairs,theMinistryofPublicSecurityandtheMinistryofForeignAffairsshallstrengthencommunicationandcooperation,cooperatecloselywithrelevantdepartmentsundertheStateCouncil,andexercisefunctionsandpowersandbearliabilitieswithinthescopeoftheirrespectiveresponsibilitiesinaccordancewiththelaw.
Article5TheStateshallestablishauniformexit/entryadministrationinformationplatformtoshareinformationamongrelevantadministrativedepartments.
Article6TheStateshallestablishexit/entryborderinspectionauthoritiesattheportsopentoforeigncountries.
Chinesecitizens,foreignersaswellastransportvehiclesshallexitorenterChinaviatheportsopentoforeigncountries,orviatheplacesapprovedbytheStateCouncilorbythedepartmentsauthorizedbytheStateCouncilunderspecialcircumstances.PersonnelandtransportvehiclesthatexitorenterChinashallbesubjecttoexit/entryborderinspection.
Exit/entryborderinspectionauthoritiesshallberesponsibleforrelevantadministrationworkintherestrictedzonesofports.Onthebasisoftheneedforsafeguardingnationalsecurityandmaintainingtheorderofexit/entryadministration,exit/entryborderinspectionauthoritiesmayconductborderinspectiononthebelongingsofthepersonswhoexitorenterChina.Whennecessary,exit/entryborderinspectionauthoritiesmayconductborderinspectiononthegoodscarriedbytransportvehiclesthatexitorenterChina.However,exit/entryborderinspectionauthoritiesshallnotifytheCustomsofsuchinspections.
Article7UponapprovalbytheStateCouncil,theMinistryofPublicSecurityandtheMinistryofForeignAffairsmay,onthebasisoftheneedforexit/entryadministration,setforthregulationsonthecollectionandkeepoffingerprintsandotherbiometricidentificationinformationofthepersonswhoexitorenterChina.
WhereforeigngovernmentshavespecialregulationsonissuingvisastoChinesecitizensortheexit/entryadministrationofChinesecitizens,theChinesegovernmentmay,asthecircumstancesrequire,takecorrespondingandequivalentmeasures.
Article8Departmentsandinstitutionsthatareresponsiblefortheexit/entryadministrationshalltakepracticalmeasures,constantlyimproveserviceandadministration,enforcelawsimpartially,provideconvenientandefficientserviceandensurethesecurityandconveyanceoftheexit/entryprocedures.
ChapterII
ExitandEntryofChineseCitizens
Article9ChinesecitizenswhoexitorenterChinashall,inaccordancewiththelaw,applyforpassportsorothertraveldocuments.
Chinesecitizensboundforothercountriesorregionsshallobtainvisasorotherentrypermitsfromdestinationcountries,unlesstheChinesegovernmenthassignedvisaexemptionagreementswiththegovernmentsofthosecountries,orotherwisestipulatedbytheMinistryofPublicSecurityandtheMinistryofForeignAffairs.
ChinesecitizenswhoexitorenterChinaasseamenorworkonforeignshipsshallapplyforseamen’scertificatesinaccordancewiththelaw.
Article10ChinesecitizenswhotravelbetweentheMainlandandtheHongKongSpecialAdministrativeRegion,betweentheMainlandandtheMacaoSpecialAdministrativeRegion,andbetweentheMainlandandTaiwanRegion,shallapplyforexit/entrypermitsinaccordancewiththelaw,andabidebytherelevantprovisionsofthisLaw.ThespecificadministrativemeasuresshallbestipulatedbytheStateCouncil.
Article11ChinesecitizenswhoexitorenterChinashallsubmittheirexit/entrydocumentssuchaspassportsorothertraveldocumentstotheexit/entryborderinspectionauthoritiesforexamination,gothroughtheprescribedformalities,andmayexitorenteruponexaminationandapproval.
Forportsthatmeetrelevantconditions,exit/entryborderinspectionauthoritiesshallprovideconveniencesuchasspeciallanesfortheexitandentryofChinesecitizens.
Article12Underanyofthefollowingcircumstances,ChinesecitizensarenotallowedtoexitChina:
(1)Holdnovalidexit/entrydocuments,orrefuseorevadeborderinspection;
(2)Aresentencedtocriminalpunishments,theexecutionofwhichhavenotbeencompleted,oraresuspectsordefendantsincriminalcases;
(3)AreinvolvedinunsettledcivilcasesandnotallowedtoexitChinaupondecisionofthepeople’scourts;
(4)Aresubjecttocriminalpunishmentforimpairingborderadministration,orarerepatriatedbyothercountriesorregionsduetoillegalexitfromChina,illegalresidenceorillegalemployment,andtheNo-Exit-from-Chinaperiodhasnotexpired;
(5)Mayendangernationalsecurityorinterests,andarenotallowedtoexitChinaupondecisionbycompetentdepartmentsundertheStateCouncil;or
(6)OthercircumstancesinwhichexitfromChinaisnotallowedinaccordancewithlawsoradministrativeregulations.
Article13ChinesecitizensresidingabroadwhodesiretoreturntoChinaforpermanentresidenceshall,priortotheentry,fileapplicationswithChineseembassiesorconsulatesorotherinstitutionsstationedabroadentrustedbytheMinistryofForeignAffairs.TheymayalsofilesuchapplicationstotheoverseasChineseaffairsdepartmentsunderthelocalpeople’sgovernmentsatorabovethecountyleveloftheproposedplacesofpermanentresidenceontheirownorviatheirrelativesinChina.
Article14Whenhandlingfinancialaffairsoraffairsinvolvingeducation,medicaltreatment,transportation,telecommunications,socialinsuranceorpropertyregistration,whereidentitycertificatesarerequired,Chinesecitizensresidingabroadmayprovidetheirpassportsforproofofidentity.
ChapterIII
EntryandExitofForeigners
Section1
Visa
Article15InordertoenteringChina,foreignersshallapplytothevisa-issuingauthoritiesstationedabroadforavisa,exceptasotherwiseprovidedforinthisLaw.
Article16Visasarecategorizedasdiplomaticvisa,courtesyvisa,officialvisaandordinaryvisa.
DiplomaticorofficialvisasshallbeissuedtoforeignerswhoenterChinafordiplomaticorofficialreasons;andcourtesyvisasshallbeissuedtoforeignerswhoaregivencourtesyduetotheirspecialstatus.Thescopeandmeasuresforissuingdiplomatic,courtesyandofficialvisasshallbestipulatedbytheMinistryofForeignAffairs.
AppropriatetypesofordinaryvisashallbeissuedtoforeignerswhoenterChinaduetonon-diplomaticorofficialreasonsincludingwork,study,familyvisit,travel,businessactivitiesandtalentintroduction.ThetypesofordinaryvisaandrelevantissuancemeasuresshallbestipulatedbytheStateCouncil.
Article17Theregistereditemsofavisashallincludevisatype,name,sex,dateofbirth,numberofallowedentries,validityperiodofentryanddurationofstayoftheholder,dateandplaceofissuance,aswellaspassportnumberorotherinternationaltraveldocumentsnumber.
Article18Foreignerswhoapplyforvisasshallsubmittheirpassportsorotherinternationaltraveldocuments,aswellasinformationofspecificapplicationmatters,tothevisa-issuingauthoritiesstationedabroad.Theyshallgothroughrelevantformalitiesandacceptinterviewsinaccordancewiththerequirementsofthevisa-issuingauthoritiesstationedabroad.
Article19WhereforeignersapplyingforvisasneedtoprovidewritteninvitationsissuedbyentitiesorindividualswithinChina,theapplicantsshallprovidesuchinvitationsinaccordancewiththerequirementsofthevisa-issuingauthoritiesabroad.Entitiesorindividualsthatissuewritteninvitationsshallbeliableforthefidelityofthecontents.
Article20ForeignerswhoneedtoenterChinaurgentlyforhumanitarianreasons,orareinvitedtoenterChinaforurgentbusinessorrushrepairwork,orhaveotherurgentneeds,andholdmaterialsthatprovethecompetentdepartments’approvaloftheirapplyingforvisasatport,mayapplyforportvisaswiththevisa-issuingauthoritiesentrustedbytheMinistryofPublicSecurityattheports(hereinafterreferredtoas“portvisaauthorities”)whichareapprovedtoissueportvisasbytheStateCouncil.
TravelagenciesthatorganizeinboundtourisminaccordancewithrelevantStateregulationsmayapplyforgrouptouristvisasfromportvisaauthorities.
Foreignerswhoapplytoportvisaauthoritiesforvisasshallsubmittheirpassportsorotherinternationaltraveldocuments,aswellasrelevantinformationofspecificapplicationmatters.Theyshallgothroughrelevantformalitiesinaccordancewiththerequirementsoftheportvisaauthorities,andenterChinaattheportswheretheyapplyforvisas.
Visasissuedbyportvisaauthoritiesshallbesingleentryandthedurationofstayshallnotexceed30days.
Article21Underanyofthefollowingcircumstances,visasshallnotbeissuedtoforeigners:
(1)Wasdeported,orwasrepatriatedupondecision,andtheNo-Entry-into-Chinaperiodhasnotexpired;
(2)Issufferingfromseriousmentaldisorders,infectioustuberculosisorotherinfectiousdiseasesthatmayseverelyjeopardizethepublichealth;
(3)MayendangerChina’snationalsecurityorinterests,ordisruptsocialandpublicorder,orengageinotherillegalorcriminalactivities;
(4)ResorttofraudulentactsinvisaapplicationorcannotguaranteeexpectedexpendituresduringtheirstayinChina;
(5)Failtosubmitrelevantinformationrequiredbythevisa-issuingauthorities;or
(6)Othercircumstancesinwhichvisaauthoritiesconsideravisashouldnotbeissued.
Thevisa-issuingauthoritiesarenotrequiredtogivereasonsforrefusingtheissuanceofavisa.
Article22Underanyofthefollowingcircumstances,foreignersmaybeexemptfromapplyingforvisas:
(1)SoexemptedbasedonthevisaexemptionagreementssignedbytheChinesegovernmentwiththegovernmentsofothercountries;
(2)Holdvalidforeigners’residencepermits;
(3)Holdconnectedpassengerticketsandareintransittoathirdcountryorregionbyaninternationalaircraft,shiportrainviaChina,willstayfornotmorethan24hoursinChinawithoutleavingtheportofentry,orwillstayinthespecificzonesapprovedbytheStateCouncilwithintheprescribedtimelimit;or
(4)OthercircumstancesstipulatedbytheStateCouncilinwhichvisasmaybeexempted.
Article23WhereforeignersunderanyofthefollowingcircumstancesneedtoenterChinatemporarily,theyshallapplytoexit/entryborderinspectionagenciesforgoingthroughtheformalitiesfortemporaryentry:
(1)Foreignseamenandtheiraccompanyingfamilymembersdisembarkatcitieswheretheportsarelocated;
(2)PersonsspecifiedinSubparagraph(3)ofArticle22ofthisLawneedtoleaveports;or
(3)ForeignersneedtoenterChinatemporarilyduetoforcemajeureorforanyotherurgentreason.
Thedurationofstayfortemporaryentryshallnotexceed15days.
Forforeignerswhoapplyforgoingthroughtheformalitiesfortemporaryentry,exit/entryborderinspectionauthoritiesmayrequiresuchforeigners,thepersonsinchargeofthetransportvehiclesusedforsuchforeigners’entryortheagencieshandlingtheexit/entrybusinessfortransportvehiclestoprovidenecessaryguarantymeasures.
Section2
EntryandExit
Article24ForeignerswhoenterChinashallsubmittheirpassports,otherinternationaltraveldocuments,visasorotherentrypermitstotheexit/entryborderinspectionauthoritiesforexamination,gothroughtheprescribedformalities,andmayenteruponexaminationandapproval.
Article25Underanyofthefollowingcircumstances,foreignersshallnotbeallowedtoenterChina:
(2)AreinvolvedinanyofthecircumstancesspecifiedinSubparagraph(1)through(4)ofthefirstparagraphofArticle21ofthisLaw;
(3)MayengageinactivitiesnotconformtothetypesofvisaafterenteringChina;or
(4)Othercircumstancesinwhichentryisnotallowedinaccordancewithlawsoradministrativeregulations.
Exit/entryborderinspectionauthoritiesarenotrequiredtogivereasonsfordenyinganentry.
Article26Exit/entryborderinspectionauthoritiesshallorderforeignerswhoaredeniedentryinChinatoreturn,andshallforcethereturnofthosewhorefusetodoso.Whilewaitingforreturn,thoseforeignersshallnotleavetherestrictedzones.
Article27ForeignerswhoexitChinashallsubmittheirexit/entrydocumentsincludingpassportsorotherinternationaltraveldocumentstotheexit/entryborderinspectionauthoritiesforexamination,gothroughprescribedformalities,andmayexituponexaminationandapproval.
Article28Underanyofthefollowingcircumstances,foreignersshallnotbeallowedtoexitChina:
(1)Aresentencedtocriminalpunishments,theexecutionofwhicharenotcompleted,orsuspectsordefendantsincriminalcases,exceptthosewhoaresentencedandtransferredunderrelevantagreementsbetweenChinaandforeigncountries;
(2)AreinvolvedinunsettledcivilcasesandarenotallowedtoexitChinaupondecisionofthepeople’scourts;
(3)AreinarrearsofpayingofflaborremunerationandthereforearenotallowedtoexitbydecisionoftherelevantdepartmentsundertheStateCouncilorofthepeople’sgovernmentsofprovinces,autonomousregionsormunicipalitiesdirectlyundertheCentralGovernment;or
(4)Othercircumstancesinwhichexitshallnotbeallowedinaccordancewithlawsoradministrativeregulations.
ChapterIV
StayandResidenceofForeigners
StayandResidence
Article29Wherethedurationofstayspecifiedinavisaheldbyaforeignerdoesnotexceed180days,theholdermaystayinChinawithinthedurationspecifiedtherein.
Wherethedurationofstayneedstobeextended,thevisaholdershallfileanapplicationwiththeexit/entryadministrationofpublicsecurityorganunderthelocalpeople’sgovernmentatorabovethecountylevelintheplaceofhisstaysevendayspriortotheexpiryofthedurationspecifiedinthevisa,andshallsubmitinformationofspecificapplicationmattersinaccordancewithrelevantrequirements.Ifuponexamination,thereasonsforextensionareappropriateandsufficient,suchextensionshallbegranted;ifanextensionisdenied,theforeignershallleaveChinaontheexpiryoftheduration.
Theaccumulatedlengthofextensionshallnotexceedtheoriginaldurationofstayspecifiedinthevisa.
Article30Wherevisasheldbyforeignersspecifythatforeignersneedtoapplyforresidencepermitsafterentry,suchforeignersshall,within30daysfromthedateoftheirentry,applytotheexit/entryadministrationsofpublicsecurityorgansunderlocalpeople’sgovernmentsatorabovethecountylevelintheproposedplacesofresidenceforforeigners’residencepermits.
Applicantsforforeigners’residencepermitsshallsubmittheirpassportsorotherinternationaltraveldocuments,aswellasrelevantinformationofspecificapplicationmatters,andprovidebiometricidentificationinformationsuchasfingerprints.Theexit/entryadministrationsofpublicsecurityorgansshall,within15daysuponthedateofreceipt,conductexaminationandmakeadecisionthereupon.Basedonthepurposeofresidence,thoseadministrationsshallissuetheappropriatetypesofforeigners’residencepermitswiththeduration.
Thevalidityperiodofaforeigner’swork-typeresidencepermitshallbe90daysattheminimumandfiveyearsatthemaximum;andthevalidityperiodofanon-work-typeforeigner’sresidencepermitshallbe180daysattheminimumandfiveyearsatthemaximum.
Article31Underanyofthefollowingcircumstances,aforeigner’sresidencepermitshallnotbeissued:
(1)Thevisahelddoesnotbelongtothetypeforwhichaforeigner’sresidencepermitshouldbeissued;
(2)Resortstofraudulentactsinapplication;
(3)Failstoproviderelevantsupportingmaterialsinaccordancewithrelevantregulations;
(4)IsnoteligibletoresideinChinabecauseofviolationofrelevantChineselawsoradministrativeregulations;or
(5)Othercircumstancesinwhichtheissuingauthorityconsidersaforeigner’sresidencepermitshouldnotbeissued.
ForeignerswithexpertiseandforeigninvestorswhoconformtorelevantStateregulationsorforeignerswhoneedtochangetheirstatusfromstaytoresidenceforhumanitarianorotherreasons,mayundergotheformalitiesforobtainingforeigner’sresidencepermitsuponapprovalbytheexit/entryadministrationsofpublicsecurityorgansunderlocalpeople’sgovernmentsatorabovethecitywithdistricts.
Article32ForeignersresidinginChinawhoapplyfortheextensionofthedurationofresidenceshall,within30dayspriortotheexpiryofthevalidityperiodontheirresidencepermits,fileapplicationswiththeexit/entryadministrationsofpublicsecurityorgansunderlocalpeople’sgovernmentsatorabovethecountylevel,andsubmitrelevantinformationofspecificapplicationmattersinaccordancewithrelevantrequirements.Ifuponexamination,thereasonsforextensionareappropriateandsufficient,anextensionshallbegranted;ifanextensionisdenied,theforeignerconcernedshallleaveChinaontheexpiryofthevalidityperiodspecifiedintheirresidencepermits.
Article33Theregistereditemsofaforeignresidencepermitshallincludename,sex,dateofbirth,reasonforresidenceanddurationofresidenceoftheholder,dateandplaceofissuance,passportnumberorotherinternationaltraveldocumentsnumber.
Wheretheregisterediteminaforeigner’sresidencepermithaschanged,theholdershall,within10daysfromthedateofchange,applytotheexit/entryadministrationofpublicsecurityorganunderthelocalpeople’sgovernmentatorabovethecountylevelintheplaceofresidenceforgoingthroughtheformalitiesforalteration.
Article34Wherevisa-exemptforeignersneedtostayinChinalongerthanthevisa-freeperiod,orforeignseamenandtheiraccompanyingfamilymembersneedtoleavethecitieswheretheportsarelocated,orunderothercircumstancesinwhichforeigners’staypermitsshouldbeappliedfor,theyshallapplyforsuchpermitsinaccordancewithrelevantregulations.
Themaximumvalidityperiodofaforeigner’sstaypermitshallbe180days.
Article35Whereordinaryvisas,stayorresidencepermitsheldbyforeignersneedtobereissuedduetodamage,loss,theft,robberyorotherreasonsincompliancewithrelevantStateregulationsafterforeignersenterChina,thoseforeignersshallapplyforareissuewiththeexit/entryadministrationsofpublicsecurityorgansunderlocalpeople’sgovernmentsatorabovethecountylevelintheplacesofstayorresidenceinaccordancewithrelevantregulations.
Article36Decisionsmadebytheexit/entryadministrationofpublicsecurityorganonrejectingapplicationsforvisaextensionorreissuance,oronnotissuingforeigners’stayorresidencepermitsornotextendingthedurationofresidenceshallbefinal.
Article37ForeignerswhostayorresideinChinashallnotengageinactivitiesnotcorrespondingtothepurposeofstayorresidence,andshallleaveChinapriortotheexpiryoftheprescribeddurationofstayorresidence.
Article38Foreignershavingreachedtheageof16whostayorresideinChinashallcarrywiththemtheirpassportsorotherinternationaltraveldocuments,orforeigners’stayorresidencepermits,andaccepttheinspectionofpublicsecurityorgans.
ForeignerswhoresideinChinashall,withintheprescribedtimelimit,submitforeigners’residencepermitstopublicsecurityorgansunderlocalpeople’sgovernmentsatorabovethecountylevelintheplacesofresidenceforexamination.
Article39WhereforeignersstayinhotelsinChina,thehotelsshallregistertheiraccommodationinaccordancewiththeregulationsonthepublicsecurityadministrationofthehotelindustry,andsubmitforeigners’accommodationregistrationinformationtothepublicsecurityorgansintheplaceswherethehotelsarelocated.
Forforeignerswhoresideorstayindomicilesotherthanhotels,theyorthepersonswhoaccommodatethemshall,within24hoursaftertheforeigners’arrival,gothroughtheregistrationformalitieswiththepublicsecurityorgansintheplacesofresidence.
Article40ForforeigninfantsborninChina,theirparentsoragentsshall,within60daysaftertheyareborn,onthestrengthofthebirthcertificates,gothroughtheformalitiesforstayorresidenceregistrationforthemwiththeexit/entryadministrationsofpublicsecurityorgansunderpeople’sgovernmentsatorabovethecountylevelintheplacesoftheirparents’stayorresidence.
ForforeignerswhodeceaseinChina,theirrelatives,guardiansoragentsshall,inaccordancewithrelevantregulations,onthestrengthofthedeathcertificates,reporttheirdeathtotheexit/entryadministrationsofthepublicsecurityorgansunderlocalpeople’sgovernmentsatorabovethecountyleveltocanceltheirstayorresidencepermits.
Article41ForeignerswhoworkinChinashallobtainworkpermitsandwork-typeresidencepermitsinaccordancewithrelevantregulations.Noentitiesorindividualsshallemployforeignerswhohavenoworkpermitsorwork-typeresidencepermits.
TheadministrativemeasuresforforeignersworkinginChinashallbestipulatedbytheStateCouncil.
Article42ThecompetentdepartmentofhumanresourcesandsocialsecurityandthecompetentdepartmentinchargeofforeignexpertsaffairsundertheStateCouncilshall,inconjunctionwithrelevantdepartmentsundertheStateCouncil,formulateandregularlyadjusttheguidingcatalogueforforeignersworkinginChinabasedontheneedsforeconomicandsocialdevelopmentaswellasthesupplyanddemandofhumanresources.
ThecompetentdepartmentofeducationundertheStateCouncilshall,inconjunctionwithrelevantdepartmentsundertheStateCouncil,establishanadministrativesystemforforeignstudentsworkingtosupporttheirstudyinChinaandsetforthregulationsonthescopeofjobsandthelimitofworktimeforsuchforeignstudents.
Article43Anyofthefollowingactsofforeignersshallbedeemedunlawfulemployment:
(1)WorkinChinawithoutobtainingworkpermitsorwork-typeresidencepermitsinaccordancewithrelevantregulations;
(2)WorkinChinabeyondthescopeprescribedintheworkpermits;or
(3)ForeignstudentsworkinviolationoftheregulationsontheadministrationofforeignstudentsworkingtosupporttheirstudyinChinaandworkbeyondtheprescribedscopeofjobsorprescribedtimelimit.
Article44Onthebasisoftheneedformaintainingnationalsecurityandpublicsecurity,publicsecurityorgansandnationalsecurityorgansmayimposerestrictionsonforeignersandforeigninstitutionsfromestablishingplacesofresidenceorworkincertainareas;andmayorderthatestablishedplacesofresidenceorworkberelocatedwithinaprescribedtimelimit.
Withoutapproval,foreignersshallnotaccessforeigner-restrictedareas.
Article45Entitiesthatemployforeignersorenrollforeignstudentsshallreportrelevantinformationtolocalpublicsecurityorgansinaccordancewithrelevantregulations.
Citizens,legalpersonsorotherorganizationswhofindforeignersillegalenter,resideorworkinChinashalldulyreportsuchmattertothelocalpublicsecurityorgans.
Article46Foreignersapplyingforrefugeestatusmay,duringthescreeningprocess,stayinChinaonthestrengthoftemporaryidentitycertificatesissuedbypublicsecurityorgans;foreignerswhoarerecognizedasrefugeesmaystayorresideinChinaonthestrengthofrefugeeidentitycertificatesissuedbypublicsecurityorgans.
PermanentResidence
Article47ForeignerswhohavemaderemarkablecontributiontoChina’seconomicandsocialdevelopmentormeetotherconditionsforpermanentresidenceinChinamayobtainpermanentresidencestatusuponapplicationapprovedbytheMinistryofPublicSecurity.
Theadministrativemeasuresforexaminationandapprovalofforeigners’permanentresidenceinChinashallbestipulatedbytheMinistryofPublicSecurityandtheMinistryofForeignAffairsinconjunctionwithrelevantdepartmentsundertheStateCouncil.
Article48ForeignerswhohaveobtainedpermanentresidencestatusmayresideorworkinChinaonthestrengthofpermanentresidencepermits,andexitorenterChinaonthestrengthoftheirpassportsandpermanentresidencepermits.
Article49Whereforeignersfallunderanyofthefollowingcircumstances,theMinistryofPublicSecurityshalldecidetocanceltheirpermanentresidencestatusinChina:
(1)EndangerChina’snationalsecurityorinterests;
(2)Aredeported;
(3)ObtainpermanentresidencestatusinChinabyfraudulentacts;
(4)FailtoresideinChinafortheprescribedtimelimit;or
(5)OthercircumstancesinwhichforeignersarenoteligibletoresideinChinapermanently.
ChapterV
BorderInspectionofTransportVehiclesExiting/EnteringChina
Article50TransportvehiclesthatexitorenterChinashallbesubjecttoborderinspectionwhenleavingorarrivingatports.BorderinspectionofenteringtransportvehiclesshallbeconductedatthefirstarrivingportinChina;borderinspectionofexitingtransportvehiclesshallbeconductedatthelastportwhentheyleaveChina.Underspecialcircumstances,borderinspectionmaybeconductedinplacesdesignatedbycompetentauthorities.
Withoutthepermissionofexit/entryborderinspectionauthoritiesinaccordancewithprescribedprocedures,transportvehiclesthatexitChinashallnotembarkordisembarkpassengers,orloadandunloadgoodsorarticlesbetweenexitinspectionandexit,andnorshalltransportvehiclesthatenterChinadosobetweenentryandentryinspection.
Article51Personsinchargeoftransportvehiclesoragencieshandlingtheexit/entrybusinessfortransportvehiclesshall,inaccordancewithrelevantregulations,reporttotheexit/entryborderinspectionauthoritiesinadvanceontheenteringorexitingtransportvehicles’timeofarrivalatordeparturefromtheportandtheplacesofstay,andtruthfullydeclareinformationincludingstaff,passengers,goodsandarticles.
Article52Personsinchargeoftransportvehiclesoragencieshandlingtheexit/entrybusinessfortransportvehiclesshallprovidecooperationinexit/entryborderinspection,andshallimmediatelyreportanyviolationsofthisLawfoundtherebyandgiveassistanceintheinvestigationandhandlingofsuchviolations.
WheretransportvehiclesthatenterChinacarrypersonswhoarenotallowedtoenterChina,thepersonsinchargeofthetransportvehiclesshallberesponsiblefortheirleaving.
Article53Exit/entryborderinspectionauthoritiesshallsupervisetransportvehiclesthatexitorenterChinaunderanyofthefollowingcircumstances:
(1)BetweenexitborderinspectionandexitfortransportvehiclesthatexitChina,andbetweenentryandentryborderinspectionfortransportvehiclesthatenterChina;
(2)WhenforeignshipsnavigateinChina’sinlandwaters;or
(3)Othercircumstancesinwhichsupervisionisnecessary.
Article54Personswhoneedtoembarkonordisembarkfromforeignshipsforreasonssuchasgoodsloadingorunloading,maintenanceoperationsorvisitshallapplytoexit/entryborderinspectionauthoritiesforboardingpass.
WhereaChineseshipneedstoberthalongsideaforeignship,oraforeignshipneedstoberthalongsideanotherforeignship,thecaptainortheagencyhandlingtheexit/entrybusinessforrelevanttransportvehiclesshallapplytotheexit/entryborderinspectionauthorityforgoingthroughformalitiesforberth.
Article55Foreignshipsandaircraftsshallnavigateaccordingtoprescribedroutes.
ShipsandaircraftsthatexitorenterChinashallnotaccessareasoutsidetheportsopentoforeigncountries.Theaforesaidshipsoraircraftsthataccesssuchareasduetounforeseeableemergenciesorforcemajeureshallimmediatelyreporttothenearestexit/entryborderinspectionauthorityorlocalpublicsecurityorgan,andacceptsupervisionandadministration.
Article56Underanyofthefollowingcircumstances,transportvehiclesshallbenotallowedtoexitorenterChina;thosethathaveleftportsmaybeorderedtoreturn:
(1)ExitorenterChinawithoutexaminationandapprovalwhenleavingorarrivingatport;
(2)Changetheportofexitorentrywithoutapproval;
(3)AresuspectedofcarryingpersonswhoarenotallowedtoexitorenterChinaandthereforeneedtobeinspectedandverified;
(4)Aresuspectedofcarryingarticlesendangeringnationalsecurityorinterestsordisruptingsocialorpublicorderandthereforeneedtobeinspectedandverified;or
(5)Othercircumstancesinwhichtransportvehiclesrefusetosubjectthemselvestoexit/entryborderinspectionauthorities’administration.
Afterthecircumstancesspecifiedintheprecedingparagraphdisappear,exit/entryborderinspectionauthoritiesshallimmediatelyreleaserelevanttransportvehicles.
Article57Agencieshandlingtheexit/entrybusinessfortransportvehiclesshallfilerecordswithexit/entryborderinspectionauthorities.Foragentsengaginginsuchabusiness,theentitiestheyworkforshallfilerelevantrecordsforthemwithexit/entryborderinspectionauthorities.
ChapterVI
InvestigationandRepatriation
Article58Measuresforon-the-spotinterrogation,continuedinterrogation,detentionforinvestigation,movementrestrictionandrepatriationprescribedinthisChaptershallbeenforcedbypublicsecurityorgansunderlocalpeople’sgovernmentsatorabovethecountylevelorbyexit/entryborderinspectionauthorities.
Article59Personssuspectedofviolatingtheregulationsonexit/entryadministrationmaybeinterrogatedonthespot;uponon-the-spotinterrogation,theaforesaidpersonsmaybeinterrogatedincontinuationinaccordancewiththelawunderanyofthefollowingcircumstances:
(1)AresuspectedofillegallyexitingorenteringChina;
(2)AresuspectedofassistingothersinillegallyexitingorenteringChina;
(3)AreforeignerssuspectedofillegallyresidingorworkinginChina;or
(4)Aresuspectedofendangeringnationalsecurityorinterests,disruptingsocialorpublicorder,orengaginginotherillegalorcriminalactivities.
On-the-spotinterrogationandcontinuedinterrogationshallbeconductedinaccordancewiththeproceduresprescribedinthePeople’sPoliceLawofthePeople’sRepublicofChina.
Wherepublicsecurityorgansunderlocalpeople’sgovernmentsatorabovethecountylevelorexit/entryborderinspectionauthoritiesneedtosummonthepersonssuspectedofviolatingtheregulationsonexit/entryadministration,theyshallhandlethematterinaccordancewiththerelevantregulationsoftheLawofthePeople’sRepublicofChinaonPenaltiesforAdministrationofPublicSecurity.
Article60WhereforeignersinvolvedinanyofthecircumstancesspecifiedinthefirstparagraphofArticle59ofthisLawcannotbeclearedofsuspicionafteron-the-spotinterrogationorcontinuedinterrogationandthereforeneedtobefurtherinvestigated,hemaybedetainedforinvestigation.
Whendetainingaforeignerforinvestigation,theauthorityconcernedshallpresentawrittendecisionondetentionforinvestigationandshallinterrogatethedetainedforeignerwithin24hours.Wheretheaforesaidorganfindsthataforeignershouldnotbedetainedforinvestigation,itshallimmediatelyreleasehimfromdetentionforinvestigation.
Theperiodofdetentionforinvestigationshallnotexceed30days;forcomplicatedcases,theperiodmaybeextendedto60daysuponapprovalbythepublicsecurityorgansunderthelocalpeople’sgovernmentsatthenexthigherlevelorbytheexit/entryborderinspectionauthoritiesatthenexthigherlevel.Forforeignerswhosenationalitiesandidentitiesareunknown,theperiodofdetentionforinvestigationshallbecalculatedfromthedatewhentheirnationalitiesandidentitiesarefoundout.
Article61Underanyofthefollowingcircumstances,detentionforinvestigationisnotapplicabletoforeigners,however,theirmovementsmayberestricted:
(1)Sufferfromseriousdiseases;
(2)Arepregnantorbreast-feedingtheirowninfantsunderoneyearofage;
(3)Areunder16yearsofageorhavereachedtheageof70;or
(4)Othercircumstancesinwhichdetentionforinvestigationshouldnotbeapplied.
Foreignerswhosemovementsarerestrictedshallsubjectthemselvestoinvestigationasrequired,andshallnotleavetherestrictedzoneswithoutapprovalofpublicsecurityorgans.Theperiodofmovementrestrictionshallnotexceed60days.Forforeignerswhosenationalitiesandidentitiesareunknown,theperiodofmovementrestrictionshallbecalculatedfromthedatewhentheirnationalitiesandidentitiesarefoundout.
Article62Underanyofthefollowingcircumstances,foreignersmayberepatriated:
(1)AreorderedtoexitChinawithinaprescribedtimelimitbutfailtodoso;
(2)AreinvolvedincircumstancesinwhichtheyarenotallowedtoenterChina;
(3)IllegallyresideorworkinChina;or
(4)NeedtoberepatriatedforviolationofthisLaworotherlawsoradministrativeregulations.
Otheroverseaspersonnelwhofallunderanyofthecircumstancesprescribedintheprecedingparagraphmayberepatriatedinaccordancewiththelaw.
RepatriatedpersonsshallnotbeallowedtoenterChinaforonetofiveyears,calculatingfromthedateofrepatriation.
Article63Personswhoaredetainedforinvestigationorwhoaretoberepatriatedupondecisionbutcannotberepatriatedpromptlyshallbeheldincustodyindetentionhousesorplacesofrepatriation.
Article64ForeignersdissatisfiedwiththemeasureimposedontheminaccordancewiththisLaw,suchascontinuedinterrogation,detentionforinvestigation,movementrestrictionorrepatriation,mayapplyforadministrativereconsiderationinaccordancewiththelaw,andtheadministrativereconsiderationdecisionshallbefinal.
WhereotheroverseaspersonneldissatisfiedwiththedecisionofrepatriationimposedontheminaccordancewiththisLawapplyforadministrativereconsideration,theprovisionsintheprecedingparagraphareapplicable.
Article65WherepersonsarenotallowedtoexitorenterChinaupondecisionsmadeinaccordancewiththelaw,thedecision-makingauthoritiesshalldulyinformtheexit/entryborderinspectionauthoritiesofsuchdecisionsinaccordancewithrelevantregulations;wherethecircumstancesinwhichthepersonsarenotallowedtoexitorenterChinadisappear,thedecision-makingauthoritiesshalldulycanceltheaforesaiddecisionsandinformexit/entryborderinspectionauthoritiesofthecancellation.
Article66Onthebasisoftheneedforsafeguardingnationalsecurityandmaintainingtheorderofexit/entryadministration,exit/entryborderinspectionauthoritiesmay,whennecessary,searchthepersonsenteringandexitingthecountry.PersonalSearchshallbeconductedbytwoborderinspectorswhoarethesamesexasthepersonssubjecttothesearch.
Article67Insuchcasesthattheexit/entrydocumentssuchasvisasorforeigners’stayorresidencepermitsaredamaged,lostorstolen,orthataftertheissuanceofsuchdocuments,theholdersarefoundnoteligibleforbeingissuedsuchdocuments,theissuingauthoritiesshalldeclaretheaforesaiddocumentsvoid.
Exit/entrydocumentswhichareforged,altered,obtainedbyfraudulentmeansoraredeclaredvoidbyissuingauthoritiesshallbeinvalid.
Publicsecurityorgansmaycancelorconfiscatetheexit/entrydocumentsprescribedintheprecedingparagraphorusedfraudulentlybypersonsotherthanthespecifiedholders.
Article68Publicsecurityorgansmayseizethetransportvehiclesusedtoorganize,transportorassistothersinillegallyexitingorenteringChinaaswellasthearticlesneededasevidenceinhandlingthecases.
Publicsecurityorgansshallseizebannedarticles,documentsanddatainvolvingstatesecrets,aswellastoolsusedinactivitiesviolatingtheregulationsonexit/entryadministration,andhandletheminaccordancewithrelevantlawsoradministrativeregulations.
Article69Theauthenticityofexit/entrydocumentsshallbedeterminedbytheissuingauthorities,theexit/entryborderinspectionauthoritiesortheexit/entryadministrationsofpublicsecurityorgans.
ChapterVII
LegalLiabilities
Article70UnlessotherwiseprovidedforinthisChapter,theadministrativepenaltiesprescribedinthisChaptershallbedecidedbythepublicsecurityorgansunderlocalpeople’sgovernmentsatorabovethecountylevelortheexit/entryborderinspectionauthorities.PenaltiesinvolvingtheimpositionofwarningsorfinesofnotmorethanRMB5,000yuanmaybedecidedbytheexit/entryadministrationsofpublicsecurityorgansunderlocalpeople’sgovernmentsatorabovethecountylevel.
Article71PersonswhocommitanyofthefollowingactsshallbefinednotlessthanRMB1,000yuanbutnotmorethanRMB5,000yuan;wherecircumstancesareserious,suchpersonsshallbedetainedfornotlessthanfivedaysbutnotmoretendaysandmayalsobefinednotlessthanRMB2,000yuanbutnotmorethanRMB10,000yuan.
(1)ExitorenterChinawithforged,alteredorfraudulentlyobtainedexit/entrydocuments;
(2)ExitorenterChinausingothers’exit/entrydocuments;
(3)Evadeexit/entryborderinspection;or
(4)IllegallyexitorenterChinainanyotherway.
Article72PersonswhoassistothersinillegallyexitingorenteringChinashallbefinednotlessthanRMB2,000yuanbutnotmorethanRMB10,000yuan;wherecircumstancesareserious,theyshallbedetainedfornotlessthan10daysbutnotmorethan15daysandshallalsobefinednotlessthanRMB5,000yuanbutnotmorethanRMB20,000yuan,andtheillegalgains,ifany,shallbeconfiscated.
EntitiesengaginginanyoftheactsprescribedintheprecedingparagraphshallbefinednotlessthanRMB10,000yuanbutnotmorethanRMB50,000yuan,withtheillegalgainsconfiscatedifthereareany;andthepersonsinchargeoftheentitieswhoaredirectlyresponsibleandotherpersonsdirectlyresponsibleshallbepunishedinaccordancewiththeprovisionsintheprecedingparagraph.
Article73Personswhoobtainexit/entrydocumentssuchasvisasorstayorresidencepermitsbyresortingtofraudulentactsshallbefinednotlessthanRMB2,000yuanbutnotmorethanRMB5,000yuan;wherecircumstancesareserious,theyshallbedetainedfornotlessthan10daysbutnotmorethan15daysandshallalsobefinednotlessthanRMB5,000yuanbutnotmorethanRMB20,000yuan.
EntitiesengaginginanyoftheactsprescribedintheprecedingparagraphshallbefinednotlessthanRMB10,000yuanbutnotmorethanRMB50,000yuan;andthepersonsinchargeoftheentitieswhoaredirectlyresponsibleandotherpersonsdirectlyresponsibleshallbepunishedinaccordancewiththeprovisionsintheprecedingparagraph.
Article74PersonswhoissuewritteninvitationsorotherapplicationmaterialstoforeignersinviolationofthisLawshallbefinednotlessthanRMB5,000yuanbutnotmorethanRMB10,000yuan,withtheillegalgainsconfiscatedifthereareany,andshallalsobeorderedtobearexitexpensesoftheinvitedforeigners.
EntitiesengaginginanyoftheactsprescribedintheprecedingparagraphshallbefinednotlessthanRMB10,000yuanbutnotmorethanRMB50,000yuan,withtheillegalgainsconfiscatedifthereareany,andshallalsobeorderedtobearexitexpensesoftheinvitedforeigners;thepersonsinchargeoftheentitieswhoaredirectlyresponsibleandotherpersonsdirectlyresponsibleshallbepunishedinaccordancewiththeprovisionsintheprecedingparagraph.
Article75WhereChinesecitizensarerepatriatedduetoillegallygoingtoothercountriesorregionsafterexitingChina,exit/entryborderinspectionauthoritiesshallconfiscatetheirexit/entrydocuments.Exit/entrydocumentissuingauthoritiesshallrefusetoissuenewexit/entrydocumentstosuchcitizensforaperiodrangingfromsixmonthstothreeyearscalculatingfromthedateoftheirrepatriation.
Article76Underanyofthefollowingcircumstances,awarningshallbegiven,andafineofnotmorethanRMB2,000yuanmayalsobeimposed:
(1)Foreignersrefusetoacceptexaminationoftheirexit/entrydocumentsbypublicsecurityorgans;
(2)Foreignersrefusetosubmittheirresidencepermitsforexamination;
(3)Personsconcernedfailtogothroughtheformalitiesforforeigners’birthregistrationordeathdeclarationinaccordancewithrelevantregulations;
(4)Foreignersfailtogothroughtheformalitiesforalteringregistrationinaccordancewiththerelevantregulationswhenthereisanychangeintheregistereditemsintheirresidencepermits;
(5)ForeignersinChinauseothers’exit/entrydocuments;or
(6)PersonsconcernedfailtogothroughregistrationformalitiesinaccordancewiththeprovisionsinthesecondparagraphofArticle39ofthisLaw.
HotelsthatfailtoprocessaccommodationregistrationforforeignersshallbepunishedinaccordancewiththerelevantprovisionsoftheLawofthePeople’sRepublicofChinaonPenaltiesforAdministrationofPublicSecurity;hotelsthatfailtosubmitforeigners’accommodationregistrationinformationtopublicsecurityorgansshallbegivenawarning;wherecircumstancesareserious,suchhotelsshallbefinednotlessthanRMB1,000yuanbutnotmorethanRMB5,000yuan.
Article77Foreignersaccessingforeigner-restrictedareaswithoutapprovalshallbeorderedtoleavepromptly;wherecircumstancesareserious,suchforeignersshallbedetainedfornotlessthanfivedaysbutnotmorethantendays.Thetextrecords,audio-visualdata,electronicdataandotherarticlesillegallyobtainedthereofbytheforeignersshallbeconfiscatedordestroyed,andthetoolsusedfortheaforementionedpurposesshallbeconfiscated.
Foreignersorforeigninstitutionsrefusingtoexecutedecisionsmadebypublicsecurityorgansornationalsecurityorgansorderingthemtorelocatewithinaprescribedtimelimitshallbegivenawarningandberelocatedmandatorily;wherecircumstancesareserious,relevantresponsiblepersonsshallbedetainedfornotlessthanfivedaysbutnotmorethanfifteendays.
Article78ForeignerswhoresideinChinaillegallyshallbegivenawarning;wherecircumstancesareserious,theyshallbeimposedwithafineofRMB500yuanperday,withacapofRMB10,000yuanintotal,orbedetainedfornotlessthanfivedaysbutnotmorethan15days.
Whereguardiansorotherpersonsresponsibleforguardianshipfailtoperformtheguardianobligationandresultinforeignersbelow16yearsofageresidinginChinaillegally,thesaidguardiansorotherobligatedpersonsshallbegivenawarningandmayalsobefinednotmorethanRMB1,000yuan.
Article79PersonsharboringorhidingforeignerswhoillegallyenterorresideinChina,orassistingsuchforeignersinevadinginspection,orproviding,inviolationofthelaw,exit/entrydocumentsforforeignerswhoillegallyresideinChinashallbefinednotlessthanRMB2,000yuanbutnotmorethanRMB10,000yuan;wherecircumstancesareserious,suchpersonsshallbedetainedfornotlessthanfivedaysbutnotmorethanfifteendaysandshallalsobefinednotlessthanRMB5,000yuanbutnotmorethanRMB20,000yuan,withtheillegalgainsconfiscatedifthereareany.
Article80ForeignerswhoworkinChinaillegallyshallbefinednotlessthanRMB5,000butnotmorethanRMB20,000yuan;wherecircumstancesareserious,theyshallbedetainedfornotlessthanfivedaysbutnotmorethanfifteendaysandshallalsobefinednotlessthanRMB5,000yuanbutnotmorethanRMB20,000yuan.
PersonswhointroducejobstoineligibleforeignersshallbefinedRMB5,000yuanforeachjobillegallyintroducedtooneforeigner,withacapofnotmorethanRMB50,000yuanintotal;andentitiesthatintroducejobstoineligibleforeignersshallbefinedRMB5,000yuanforeachjobillegallyintroducedtooneforeigner,withacapofRMB100,000yuanintotal;andtheillegalgains,ifany,shallbeconfiscated.
IndividualsorentitiesthatillegallyemployforeignersshallbefinedRMB10,000yuanforeachillegallyemployedforeigner,withacapofRMB100,000yuanintotal;andtheillegalgains,ifany,shallbeconfiscated.
Article81Whereforeignersengageinactivitiesnotcorrespondingtothepurposesofstayorresidence,orotherwiseviolatethelawsorregulationsofChina,whichmakesthemnolongereligibletostayorresideinChina,theymaybeorderedtoexitChinawithinatimelimit.
Whereaforeigner’sviolationofthisLawisseriousbutdoesnotconstituteacrime,theMinistryofPublicSecuritymaydeportthem.ThepenaltydecisionmadebytheMinistryofPublicSecurityshallbefinal.
DeportedforeignersshallnotbeallowedtoenterChinawithin10yearscalculatingfromthedateofdeportation.
Article82Underanyofthefollowingcircumstances,relevantpersonsshallbegivenawarningandmayalsobefinednotmorethanRMB2,000yuan:
(1)Disrupttheadministrativeorderoftherestrictedzonesofports;
(2)Foreignseamenortheiraccompanyingfamilymembersdisembarkwithoutgoingthroughtheformalitiesfortemporaryentry;or
(3)Embarkonordisembarkfromforeignshipswithoutobtainingboardingpasses.
PersonswhoviolateSubparagraph(1)oftheprecedingparagraphmaybedetainedfornotlessthanfivedaysbutnotmorethantendaysifthecircumstancesareserious.
Article83Wheretransportvehiclesfallunderanyofthefollowingcircumstances,thepersonsinchargeofthetransportvehiclesshallbefinednotlessthanRMB5,000yuanbutnotmorethanRMB50,000yuan:
(1)ExitorenterChinawithoutexaminationandapproval,orchangetheportsofexitorentrywithoutapproval;
(2)Failtotruthfullydeclareinformationofstaff,passengers,goodsorarticles,orrefusetoassistinexit/entryborderinspection;or
(3)Embarkordisembarkpassengers,orloadorunloadgoodsorarticlesinviolationoftheregulationsonexit/entryborderinspection.
TransportvehiclesthatexitorenterChinacarryingpersonswhoarenotallowedtoexitorenterChinashallbefinednotlessthanRMB5,000yuanbutnotmorethanRMB10,000yuanforeachaforesaidpersoncarried.Wherethepersonsinchargeofthetransportvehiclesprovethattheyhavetakenreasonablepreventativemeasures,theymaybegivenmitigatedpenaltiesorbeexemptfrompenalties.
Article84Wheretransportvehiclesfallunderanyofthefollowingcircumstances,thepersonsinchargeofthetransportvehiclesshallbefinednotlessthanRMB2,000yuanbutnotmorethanRMB20,000yuan:
(1)Chineseorforeignshipsberthalongsideforeignshipswithoutapproval;
(2)ForeignshipsoraircraftsfailtonavigateaccordingtotheprescribedroutesinChina;or
(3)ShipsandaircraftsthatexitorenterChinaaccessareasoutsidetheportsopentoforeigncountries.
Article85Wherestaffmembersperformingthedutyofexit/entryadministrationcommitanyofthefollowingacts,theyshallbegivendisciplinarysanctionsinaccordancewiththelaw:
(1)Inviolationoflawsoradministrativeregulations,issueexit/entrydocumentssuchasvisasorstayorresidencepermitstoforeignerswhodonotmeettheprescribedconditions;
(2)Inviolationoflawsoradministrativeregulations,examineandallowtheexitorentryofpersonsortransportvehiclesthatdonotmeettheprescribedconditions;
(3)Divulgepersonalinformationgainedinexit/entryadministrationworkandinfringingthelegitimaterightsandinterestsofrelevantparties;
(4)FailtoturnoverinaccordancewithrelevantregulationstotheStateTreasurythefees,finesorillegalgainsorpropertythatarecollectedorconfiscatedinaccordancewiththelaw;
(5)Privatelyshare,encroachonormisappropriatethefundsorarticlesconfiscatedorseizedorthefeescollected;or
(6)Otherfailuresinperformingstatutorydutiesinaccordancewiththelaw,suchasabuseofpower,derelictionofduty,orresortingtomalpracticeforpersonalgain.
Article86Inthecaseofviolationofregulationsonexit/entryadministrationandthatafineofnotmorethanRMB500yuanshouldbeimposed,theexit/entryborderinspectionauthoritiesmaymakeapenaltydecisiononthespot.
Article87Personsorentitiesthatarefinedforviolationofregulationsonexit/entryadministrationshallpaytheirfinesinthedesignatedbankswithin15daysfromthedateofreceivingthewrittendecisiononpenalty.Whereitisdifficulttocollectfinesafterafineisimposedbecausethepersonorentitysubjecttopenaltyhasnofixeddomicileintheplacewherethefineisimposedoritisdifficulttopayfinetothedesignatedbankattheport,thefinemaybecollectedonthespot.
Article88WhereaviolationofthisLawconstitutesacrime,criminalliabilitiesshallbeinvestigatedinaccordancewiththelaw.
ChapterVIII
SupplementaryProvisions
Article89DefinitionsofthefollowingtermsmentionedinthisLaw:
ExitreferstoleavingtheChinesemainlandforothercountriesor
regions,fortheHongKongSpecialAdministrativeRegionortheMacao
SpecialAdministrativeRegion,orforTaiwanRegion.
EntryreferstoenteringtheChinesemainlandfromothercountriesorregions,fromtheHongKongSpecialAdministrativeRegionortheMacaoSpecialAdministrativeRegion,orfromTaiwanRegion.
ForeignersrefertopersonswithoutChinesenationality.
Article90UponapprovalbytheStateCouncil,provincesandautonomousregionsborderingonneighboringcountriesmay,inaccordancewiththeboundaryadministrationagreementssignedbyChinawithrelevantcountries,formulatelocalregulationsorlocalgovernmentrulestoregulatetheassociationofresidentsinborderareasofthetwocountries.
Article91Wherethereareotherregulationsontheadministrationoftheentry/exit,stayorresidenceofthemembersofforeigndiplomaticandconsularmissionsinChina,ortheentry/exit,stayorresidenceofotherforeignerswhoenjoydiplomaticprivilegesandimmunities,theseregulationsshallprevail.
Article92Foreignerswhoapplyforexit/entrydocumentssuchasvisasorforeignerstayorresidencepermitsorapplyfordocumentextensionoralterationshallpayvisafeesordocumentfeesinaccordancewithrelevantregulations.
Article93ThisLawshallcomeintoforceasofJuly1,2013.TheLawofthePeople’sRepublicofChinaontheEntryandExitAdministrationofForeignersandtheLawofthePeople’sRepublicofChinaontheEntryandExitAdministrationofChineseCitizensshallbeannulledsimultaneously.
