第一章总则
ChapterIGeneralProvisions
第一条为保障中国公民出入中国国境的正当权利和利益，促进国际交往，特制定本法。
Article1ThisLawisformulatedwithaviewtosafeguardingthelegitimaterightsandinterestsofChinesecitizenswithrespecttotheirexitfromandentryintoChina'sterritoryandtopromotinginternationalexchange.
Article2ChinesecitizensmayleaveorenterthecountrywithvalidpassportsorothervalidcertificatesissuedbythecompetentdepartmentsoftheStateCouncilorotherdepartmentsauthorizedbythem.Theyshallnotberequiredtoapplyforvisas.
第三条中国公民出境、入境，从对外开放的或者指定的口岸通行，接受边防检查机关的检查。
Article3Forexitandentry,Chinesecitizensshallpassthroughopenportsorotherdesignatedportsandshallbesubjecttoinspectionbythefrontierinspectionoffices.
第四条中国公民出境后，不得有危害祖国安全、荣誉和利益的行为。
Article4Afterleavingthecountry,Chinesecitizensmaynotcommitanyactharmfultothesecurity,honourorinterestsoftheircountry.
第二章出境
ChapterIIExitfromtheCountry
第五条中国公民因私事出境，向户口所在地的市、县公安机关提出申请，除本法第八条规定的情形外，都可以得到批准。
Article5Chinesecitizenswhodesiretoleavethecountryforprivatepurposesshallapplytothepublicsecurityorgansofthecityorcountyinwhichtheirresidenceisregistered.ApprovalshallbegrantedexceptincasesprescribedinArticle8ofthisLaw.
Thepublicsecurityorgansshalldecide,withinaspecifiedtime,whethertoapproveordisapprovethecitizens'applicationsforleavingthecountryforprivatepurposes,andshallnotifytheapplicantsaccordingly.
Article6InthecaseofChinesecitizensleavingthecountryonofficialbusiness,theunitssendingthemabroadshallapplytotheMinistryofForeignAffairsorthelocalforeignaffairsdepartmentauthorizedbytheministryforthecitizens'exitcertificatesandacquirethecertificatesforthem.
Article7Inthecaseofseamenleavingthecountrytoperformtheirduties,theBureauofHarbourSuperintendenceoraharboursuperintendentauthorizedbythebureaushallacquiretheexitcertificatesforthem.
第八条有下列情形之一的，不批准出境：
Article8Approvaltoexitfromthecountryshallnotbegrantedtopersonsbelongingtoanyofthefollowingcategories:
(1)defendantsincriminalcasesorcriminalsuspectsconfirmedbyapublicsecurityorgan,apeople'sprocuratorateorapeople'scourt;
（二）人民法院通知有未了结民事案件不能离境的；
(2)personswho,asnotifiedbyapeople'scourt,shallbedeniedexitowingtoinvolvementinunresolvedcivilcases;
（三）被判处刑罚正在服刑的；
(3)convictedpersonsservingtheirsentences;
（四）正在被劳动教养的；
(4)personsundergoingrehabilitationthroughlabour;and
（五）国务院有关主管机关认为出境后将对国家安全造成危害或者对国家利益造成重大损失的。
(5)personswhoseexitfromthecountrywill,intheopinionofthecompetentdepartmentoftheStateCouncil,beharmfultostatesecurityorcauseamajorlosstonationalinterests.
第九条有下列情形之一的，边防检查机关有权阻止出境，并依法处理：
Article9Thefrontierinspectionofficesshallhavethepowertostoppersonsbelongingtoanyofthefollowingcategoriesfromleavingthecountryandtodealwiththemaccordingtolaw:
（一）持用无效出境证件的；
(1)holdersofinvalidexitcertificates;
（二）持用他人出境证件的；
(2)holdersofexitcertificatesotherthantheirown;and
（三）持用伪造或者涂改的出境证件的。
(3)holdersofforgedoralteredexitcertificates.
第三章入境
ChapterIIIEntryintotheCountry
Article10ChinesecitizensresidingabroadwhodesiretoreturntoChinaforpermanentresidenceshallcompletetherelevantproceduresattheChinesediplomaticmissions,consularofficesorotheragencieslocatedabroadthatareauthorizedbytheMinistryofForeignAffairs,oratthepublicsecurityorgansoftherelevantprovinces,autonomousregions,ormunicipalitiesdirectlyundertheCentralGovernment.
第十一条入境定居或者工作的中国公民，入境后应当按照户口管理规定，办理常住户口登记。入境暂住的，应当按照户口管理规定办理暂住登记。
Article11AftertheirentryintoChina,Chinesecitizenswhohavecomeforpermanentresidenceoremploymentshallregisterforprolongedresidenceinaccordancewiththeprovisionsfortheadministrationofresidence.Thosewhohaveenteredforatemporarystayshallregisterfortemporaryresidenceinaccordancewiththesameprovisions.
第四章管理机关
ChapterIVAdministrativeOrgans
Article12PassportsforChinesecitizensgoingabroadonofficialbusinessshallbeissuedbytheMinistryofForeignAffairsorbythelocalforeignaffairsdepartmentsauthorizedbytheministry.
Seamen'spapersshallbeissuedbytheBureauofHarbourSuperintendenceoraharboursuperintendentauthorizedbythebureau.
PassportsforChinesecitizensgoingabroadforprivatepurposesshallbeissuedbytheMinistryofPublicSecurityorbylocalpublicsecurityorgansauthorizedbytheministry.
PassportsandcertificateswhichChinesecitizensapplyforabroadshallbeissuedbytheChinesediplomaticmissions,consularofficesorotheragencieslocatedabroadauthorizedbytheMinistryofForeignAffairs.
Article13TheMinistryofPublicSecurity,theMinistryofForeignAffairs,theBureauofHarbourSuperintendenceandotheragenciesthatissuepassportsandcertificatesshallhavethepowertocancelpassportsandcertificatesissuedbythemorbytheirauthorizedagencies,ortodeclaresuchpassportsandcertificatesinvalid.
第五章处罚
ChapterVPenalties
Article14Anypersonwho,inviolationoftheprovisionsofthisLaw,leavesorentersthecountryillegally,forgesoraltersanexitorentrycertificate,usesanotherperson'scertificateashisownortransfershiscertificatemaybegivenawarningorplacedindetentionfornotmorethantendaysbyapublicsecurityorgan.
情节严重，构成犯罪的，依法追究刑事责任。
Ifthecircumstancesofthecaseareseriousenoughtoconstituteacrime,criminalresponsibilityshallbeinvestigatedinaccordancewiththeLaw.
第十五条受公安机关拘留处罚的公民对处罚不服的，在接到通知之日起十五日内，可以向上一级公安机关提出申诉，由上一级公安机关作出最后的裁决，也可以直接向当地人民法院提起诉讼。
Article15Ifacitizensubjecttothepenaltyofdetentionbyapublicsecurityorganrefusestoacceptthepenalty,hemay,within15daysofreceivingnotification,appealtothepublicsecurityorganatthenexthigherlevel,whichshallmakethefinaldecision;hemayalsodirectlyfilesuitinthelocalpeople'scourt.
Article16WhereastatefunctionarychargedwithimplementingthisLawtakesadvantageofhispositionandpowertoextortandacceptbribes,heshallbepunishedaccordingtotheCriminalLawofthePeople'sRepublicofChinaandtheDecisionoftheStandingCommitteeoftheNationalPeople'sCongressRegardingtheSeverePunishmentofCriminalsWhoSeriouslyUnderminetheEconomy.
有其他违法失职行为，情节严重，构成犯罪的，依照《中华人民共和国刑法》有关规定追究刑事责任。
IfhehascommittedanyotheractinvolvingviolationoftheLawandderelictionofdutywhichisseriousenoughtoconstituteacrime,hiscriminalresponsibilityshallbeinvestigatedaccordingtotherelevantprovisionsoftheCriminalLawofthePeople'sRepublicofChina.
第六章附则
ChapterVISupplementaryProvisions
第十七条中国公民往来香港地区或者澳门地区的管理办法，由国务院有关部门另行制订。
Article17ControlmeasuresgoverningChinesecitizens'travelstoandfromtheHongKongortheMacaoregionshallbeseparatelyformulatedbytherelevantdepartmentsoftheStateCouncil.
第十八条在同中国毗邻国家接壤边境地区居住的中国公民临时出境、入境，有两国之间协议的，按照协议执行，没有协议的按照中国政府的规定执行。
Article18TransistoryexitfromandentryintoChinabyChinesecitizensresidinginareasborderingonaneighbouringcountryshallbehandledaccordingtoanyrelevantagreementsbetweenthetwocountriesor,intheabsenceofsuchagreements,accordingtotherelevantprovisionsoftheChineseGovernment.
国际列车和民航国际航班乘务人员、国境铁路工作人员的出境、入境，按照协议和有关规定执行。
Theexitandentryofcrewsoftransnationaltrains,crewsofcivilaviationplanesoperatinginternationalflightsandtherailwayfunctionariesworkinginChina'sborderareasshallbehandledaccordingtorelevantagreementsandprovisions.
第十九条公安部、外交部、交通部根据本法制定实施细则，报国务院批准施行。
Article19TheMinistryofPublicSecurity,theMinistryofForeignAffairsandtheMinistryofCommunicationsshall,pursuanttothisLaw,formulaterulesforitsimplementation,whichshallgointoeffectafterbeingsubmittedtoandapprovedbytheStateCouncil.
