1、REGULATIONSFORTHEIMPLEMENTATIONOFTHELAWOFTHEPEOPLESREPUBLICOFCHINAONTHEENTRYANDEXITANIMALANDPLANTQUARANTINE（PromulgatedbyDecreeNo.206oftheStateCouncilofthePeoplesRepublicofChinaonDecember2，1996）ChapterIGeneralProvisionsArticle1TheseRegulationsareformulatedinaccordancewiththeprovisionsofthe“LawofthePeoplesRepublicofChinaontheEntryandExitAnimalandPlantQuarantine”（hereinafterreferredtoastheLawontheEntryandExitAnimala

2、ndPlantQuarantine）。Article2ThefollowingobjectsshallbesubjecttoquarantineinaccordancewiththeprovisionsoftheLawontheEntryandExitAnimalandPlantQuarantineandthoseoftheseRegulations：（1）Entry，exitortransitanimalsandplants，theirproductsandotherquarantineobjects；（2）Containers，packagingmaterialsandbeddingmaterialsusedforcarryinganimalsandplants，theirproductsorotherquarantineobjects；（3）Meansoftransportfromananimalandplantepidemicare

3、a；（4）Wastevesselsfordismantlingafterentry；and（5）Othergoodsanditemssubjecttoentryandexitanimalandplantquarantineaccordingtoprovisionsofrelevantlaws，administrativeregulationsandinternationaltreatiesorasagreeduponintradecontracts.Article3ThedepartmentofagricultureadministrationundertheStateCouncilshallbeinchargeoftheentryandexitanimalandplantquarantineinthewholecountry.TheBureauofAnimalandPlantQuarantineofthePeoplesRepublic

4、ofChina（hereinafterreferredtoastheStateBureauofAnimalandPlantQuarantine）shallexerciseunifiedcontrolovertheentryandexitanimalandplantquarantineinthewholecountry，collectinformationonmajoranimalandplantepidemicsathomeandabroadandberesponsibleforinternationalcooperationandexchangesinentryandexitanimalandplantquarantine.TheStateBureauofAnimalandPlantQuarantineshallestablishportanimalandplantquarantineorgansinopenportsandatp

5、laceswherethereisconcentrationofentryandexitanimalandplantquarantineoperations，andperformentryandexitanimalandplantquarantineaccordingtotheprovisionsoftheLawontheEntryandExitAnimalandPlantQuarantineandtheseRegulations.Article4Intheeventthataseriousanimalorplantepidemicoccursoutsidetheterritoryandisliabletospreadintothecountry，thefollowingemergentpreventivemeasuresshallbeadoptedinthelightoftheprevailingconditions：（1）Th

6、eStateCouncilmaytakecontrolmeasuresintheborderregionsconcernedandmay，whennecessary，orderthebanofentryofmeansoftransportfromtheanimalandplantepidemicareaorsealtheportsconcerned；（2）ThedepartmentofagricultureadministrationundertheStateCouncilmaypublishcataloguesofanimalsandplants，theirproductsandotherquarantineobjectstheentryofwhichshallbebannedfromthecountryorregionwherethereisananimalorplantepidemic；（3）Theportanimal

7、andplantquarantineorgansconcernedmaytakeemergentquarantinemeasureswithregardtotheentryobjectslikelycontaminatedbyepidemicsorpestsaslistedinArticle2oftheseRegulations；and（4）Thelocalpeoplesgovernmentsoftheareasunderthethreatofanimalorplantepidemicmayimmediatelycallthedepartmentsconcernedtoworkoutandimplementemergentplans，andsimultaneouslyreporttothepeoplesgovernmentsatahigherlevelandtheStateBureauofAnimalandPlantQuaranti

8、ne.Thedepartmentsofpostsandtelecommunicationsanddepartmentsoftransportationshallgivetopprioritytotransmittingortransportingreportsconcerningseriousanimalorplantepidemicsormaterialstobesentforquarantineinspection.Article5Entryofanimalsandplants，theirproductsandotherquarantineobjectsforeitherofficialuseorprivateusebyforeignorganizationsandpersonnelenjoyingdiplomaticorconsularprivilegesandimmunityshallbesubjecttoquarantineinaccor

9、dancewiththeprovisionsoftheLawontheEntryandExitAnimalandPlantQuarantineandthoseoftheseRegulations；theportanimalandplantquarantineorgansshallcomplywiththeprovisionsofrelevantlawswhenperforminginspection.Article6Thecustomsshall，accordingtolaw，coordinatewithportanimalandplantquarantineorgansinexercisingsupervisionandcontroloverentryandexitanimalsandplants，theirproductsandotherquarantineobjects.SpecificmeasuresshallbeformulatedbythedepartmentofagricultureadministrationundertheStateCouncilinconjunctionwiththeGeneralAdministrationofCustoms.Article7ThecataloguesofanimalandplantepidemicareasandcountriesandregionswherethereareanimalandplantepidemicsreferredtointheLawonEntryandExitAnimalandPlantQuarantineshallbedeterminedandpublishedbythedepartmentofagricultureadministrationundertheStateCouncil.Article8Unitsandindividualsthatmakeoutstan
