Inconsiderationofthepremisesandmutualcovenantsandpromisessetforthhereinthepartiesagreeasfollows:
ONE.
PartyAherebyemploysPartyBandPartyBacceptsemploymentfromPartyAwithpositiontobedeterminedand/orsuchotherdutiesasPartyAmay,fromtimetotime,determine.TheemploymentperiodwillbefromXXXtoXXX.
TWO.Thevalidtermofemployment
Thevalidtermofemploymentisfromthedateofsigningtothedateoftheexpiryofthecontract.Ifeitherpartyhasanagreementtocontinuetheemploymentonthemonthbeforetheexpiryofthecontract,theemploymentshallbevalidforaperiodofuptothreeyears.
THREE.Probationperiod
PartyBshallworkunderaprobationperiodofthreemonths.IfPartyAregardsPartyBunsuitablefortheworkduringtheprobationperiod,PartyAmayterminatethecontractwithoutanyresponsibility.
FOUR.Worktime
PartyAmakestheworktimeplanaccordingtoPartyA'sbusinessandthelawofthegovernment.
FIVE.Remunerationandbeneficiarytreatment
1.Basicsalary:accordingtothewageandsalarypoliciesofPartyA.
2.OvertimePay:accordingtotheovertimepaypoliciesofPartyA.
3.SickLeave,No-payleave,MaternityLeave,AnnualLeave,MarriageLeave,FuneralLeaveandGovernmentstatutorypublicholidays:accordingtothelawofthegovernment.
4.BonusesandotherbenefitsshallbesubjecttoPartyA’spolicies.
SIX.Therightsandobligationsoftheparties
1.PartyAmayadjustPartyB’spositionaccordingtothebusinessrequirementandtheactualabilityofPartyB.
2.PartyAhasthepowertorenderadministrationtoPartyBaccordingitsregulations.
3.AnyandallworkproductofPartyBthatisconceivedorcreatedbyPartyBduringtheemploymentwithPartyAistheexclusivepropertyofPartyA.
4.PartyAshouldprovideprofessionaltrainingforPartyB.
5.PartyAundertakestoprovidegoodandsafeworkingconditions
6.PartyBisentitledtocorrespondingremuneration,chanceofpromotion,legalholidays,annualleaveandtheresttimeregulatedbyPartyA.
7.PartyBenjoystherighttoattendprofessionalstudyandraiseproposalsforworkimprovement.
8.PartyBhastheobligationtomaintainPartyA’sinterestandreputation,abidebyrulesanddisciplinesformulatedbyPartyA,andkeepbusinesssecretsandtechnicalsecretsofPartyA.
SEVEN.Termination
1.Thiscontractofemploymentshallautomaticallyterminateupontheoccurrenceofanyofthefollowingevents:
a.Thiscontracthasexpiredbutbothpartiesdonothaveitrenewed.
b.BankruptcyofPartyA.
c.PartyAisdissolvedorcancelledbyLaw.
d.ThedeathofPartyB.
2.PartyAmayterminateemployee’semploymentbeforecontractexpiryunderanyofthefollowingcircumstances:
a.PartyBisnotqualifiedtorequirementofPartyAduringtheprobationperiods.
b.PartyBseverelyviolatesanyofPartyA’srulesordisciplines.
c.PartyBneglectsdutyorcommitsjobberyandcausesgreatlossonPartyA’sinterests.
d.PartyBisarrested,isthesubjectofanindictment,orchargedwithanycrimeorunlawfulact.
e.PartyBprovidesthefalseinformationtogettheemployment.
3.Inanyoftheevents,thiscontractmaybeterminatedbyPartyAon30days’priorwrittennoticetoPartyB:
a.PartyBwhosuffersfromillnessorinjurynotondutyisunabletocarryouttheoriginaldutyortotakeonthenewdutyproperlyassignedbyPartyAafterthemedicaltreatmentterm.
b.PartyBisobviouslynotqualifiedtorequirementoftheoriginalduty,andthereisnootherproperposition.
c.EconomicreasonsofPartyAwhichmayariseduringthetermofthiscontractandwhichmaybebeyondthecontrolofPartyA;
d.Theconditionbeingthebaseofcontracthasbeengreatlychanged,andthecontractcan’tbecarriedout.
4.Inanyoftheevents,PartyAcan’tunilaterallyterminatethecontract:
a.PartyBisincapacitatedforillnessorinjuryfromperformingthedutiesandisinthemedicaltreatmentterm.
b.Womanemployeewhoobservesbirthcontrolpolicyisintheperiodofpregnancy,confinementorlactation.
